<p>MANILA — The Commission on Elections (Comelec) will include a conflict of interest declaration in the certificates of candidacy (COC).</p><p>Comelec issued a memorandum on Tuesday, approving the recommendation of its Law Department that a COC would contain a sworn declaration on conflict of interest.</p><p>Comelec chairman George Garcia said the memorandum will be implemented starting in the COC filing for the Barangay and Sangguniang Kabataan elections slated on Nov. 2.</p><p>The sworn declaration states: “I undertake, once elected, to comply with the provisions on conflict of interest under Republic Act Nos. 3019 and 6713, particularly as to the prohibition on having direct or indirect financial or pecuniary interest in any business, contract, or transaction that may be opposed to or affected by the faithful performance of official duty, or in which I am prohibited by the Constitution or any law from having any interest.”</p><p>Under the Republic Act (RA) 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees, conflict of interest “arises when a public official or employee is a member of a board, an officer, or a substantial stockholder of a private corporation or owner or has a substantial interest in a business, and the interest of such corporation or business, or his rights or duties therein, may be opposed to or affected by the faithful performance of official duty.”</p><p>RA 3019 or the Anti-Graft and Corrupt Practices Act restricts a public officer from “directly or indirectly having financial or pecuniary interest in any business, contract or transaction in connection with which he intervenes or takes part in his official capacity, or in which he is prohibited by the Constitution or by any law from having any interest.”</p><p>The Law Department noted that the sworn declaration is only a statement of undertaking to comply with the laws, and would not add a qualification to public office.</p><div><br/></div><div><strong>RELATED STORIES:</strong></div><div><strong><a href="https://www.abs-cbn.com/news/nation/2026/7/31/comelec-exec-urges-p191-8m-fund-request-for-cavite-special-polls-1328">Comelec exec urges P191.8M fund request for Cavite special polls</a></strong><br/><strong><a href="https://www.abs-cbn.com/news/regions/2026/6/22/comelec-begins-printing-computerized-voters-lists-ahead-of-barmm-polls-1507">Comelec begins printing computerized voters’ lists, opens data center to media ahead of BARMM polls</a></strong><br/><strong><a href="https://www.abs-cbn.com/news/nation/2026/5/27/comelec-chair-refutes-imee-s-no-el-claim-election-is-certain-in-2028-1536">Comelec chair refutes Imee&#x27;s &#x27;No-El&#x27; claim: &#x27;Election is certain in 2028’</a></strong></div>
