Prosecution gets copy of Sara Duterte's bank, tax records

<p>MANILA &mdash; The House prosecution has received from the Senate Impeachment Court the subpoenaed bank and tax records of Vice President Sara Duterte and her husband, Mans Carpio.</p><p>House Impeachment Prosecutor Terry Ridon said the panel will study the documents, which will form part of their evidence on the impeachment article alleging unexplained wealth.</p><p>&ldquo;Binigyan na ng kopya ang prosecution panel ng lahat ng mga bank information na hiningi mula sa ating pangalawang pangulo, sa kanyang asawa, at sa kanilang mga kumpanya&hellip; Binigyan na rin ng kopya ng senate impeachment court ang prosecution panel ng lahat ng tax documents ng pangalawang pangulo, ng kanyang asawa at ng kanila pong mga kumpanya&hellip; Sa mga susunod na araw, pag-aaralan at bubusisiin po natin lahat ng mga dokumentong ito. Ito ang magko-constitutue ng last important pillar ng mga ebidensyang gagamitin para sa unexplained wealth article,&rdquo; he said.</p><div><br></div><div><strong>PROPOSED MEASURE</strong></div><p>Some members of the House prosecution are considering filing a bill seeking to institutionalize the regulations on confidential and intelligence funds.</p><p>Ridon said it will &ldquo;codify&rdquo; the guidelines issued by the Commission on Audit.</p><p>&ldquo;Pinag-aaralan din po ng ilan sa mga miyembro po ng panel &lsquo;yun pong pagfa-file nung confidential and intelligence fund integrity bill. So basically iko-codify &lsquo;yun pong COA rulings at &lsquo;yun pong COA guidelines&hellip; For example, &lsquo;yung usapin po ng safe houses, halimbawa, dapat ba &lsquo;yan i-subject to a little bit more transparency, kung magkano ba dapat &lsquo;yung ginagamit na safe houses? Dapat ba &lsquo;yan subject to market rates? &lsquo;Pag ba halimbawa, &nbsp;lampas sa market rates ay kailangan na po ng go-ahead ng head of office? At &lsquo;yun bang mga lease contracts nito pong mga safe houses po na ito, katapat ba ito halimbawa, nung estado nun pong naka-lagay sa mga sealed envelopes na pangalan nun pong mga confidential agents?&rdquo; he explained.</p><p>&ldquo;On aliases, katulad po nung kailangan natin gawing paglilinaw between confidential and intelligence funds. &lsquo;Yun pong intelligence funds po kasi yung merong vault. Iyun pong confidential funds wala pong vault na pinag-usapan, nakalagay lang po dapat ito sa sealed envelopes. So very important ho na mailatag din yung actual check mechanism dito sa paggamit po ng alias,&rdquo; Ridon added.</p><p>&ldquo;We don&rsquo;t want to intrude into how the security sector is actually undertaking their operations. Pero there should still be a little bit of semblance of transparency and accountability there. So, for example, I don&#39;t think we will require names for aliases pero the real names should still be disclosed to the agency itself, and if the oversight agencies or offices would like to look into it, they should be able to do so, and they could be able to identify these personalities in executive sessions,&rdquo; he said.</p><p>&ldquo;Sa ilalim ng bagong batas na ito, baka dapat meron ng penal provisions sa pag-violate ng provisions po na ito. Syempre may mga iba pa naman laws din na puedeng gamitin, for example yung malversation nga duon sa paggamit ng confidential funds, pinag aaralan ng Ombudsman, so we will see if we can make it as aggravating circumstance if confidential or intelligence funds are involved,&rdquo; Ridon noted.</p><p>Lead House Prosecutor Gerville Luistro expressed support for the proposed measure.</p><p>&ldquo;It&#39;s high time na ma-institutionalize kung paano ba gagamitin itong confidential fund and even intelligent fund. First and foremost, sino ba talaga ang entitled sa confidential fund and intelligence fund? Ilagay na natin sa batas, hindi lang merely joint circular, itong tamang pag-request, pag-disburse at pag-liquidate ng confidential fund.
