Comelec set to proclaim Garbin as Legazpi mayor

MANILA -- The Commission on Elections has directed the Special City Board of Canvassers (SCBOC) of Legazpi City to convene on Monday next week to implement the disqualification of Noel E. Rosal as governor of Albay, Carmen Geraldine Rosal as mayor of Legazpi City, and Jose Alfonso V. Barizo as councilor of Legazpi City, during the 2022 elections.

This came after the issuance of the writ of execution relative to the certificate of finality and entry of judgment on their disqualification case.

The Comelec said the SBOC will proclaim the 2nd placer, Alfredo A. Garbin, Jr., “as the duly elected Mayor of Legazpi City in accordance with the decision of the Comelec en banc in SPA No. 22-032 (DC).”

The Supreme Court last month affirmed the disqualification of Noel Rosal, Carmen Rosal, and Jose Barizo in the May 9, 2022 National and Local Elections “for violating the Omnibus Election Code in connection with the disbursement and release of government funds during the prohibited period.”

The High Court also lifted the Status Quo Ante-Order that it issued in May 2023, ruling that the subject Comelec Resolutions should immediately take effect.

The Comelec said the SCBOC of Legazpi City has given due notice to the parties that it will convene on November 11, 10:00 A.M. at the Comelec Session Hall in Palacio del Gobernador, Intramuros, Manila to proclaim Garbin, Jr. as Legazpi City mayor.
