DOJ: Complaints vs VP Sara Duterte could be sent back to NBI

MANILA — The Department of Justice (DOJ) said it is not yet the end of the road for Vice President Sara Duterte, who is facing complaints of grave threats and inciting to sedition filed by the National Bureau of Investigation (NBI) before the National Prosecution Service (NPS).

Justice Assistant Secretary Mico Clavano said the NPS could send the complaint back to the NBI or call for a preliminary investigation, which may lead to the eventual filing of cases in court.

“'Yung antas po na tinitignan ng mga prosecutors ngayon ay hindi na probable cause, ngayon ay reasonable certainty of conviction, at mataas po 'yan na antas or level ng ebidensyang kailangan para magsampa ng kaso,” Clavano said.

(The level that prosecutors are looking for now is not probable cause but reasonable certainty of conviction. That is a higher level of evidence need to file a case in court)

He added there is no timetable for the prosecutors to complete their evaluation, which will include checking the completeness of the records submitted and checking "ministerial matters" like errors and missing signatures.

He also emphasized that while the NPS is under the DOJ, the prosecutors will evaluate the NBI complaints independently.

“We have to give them the due independence that they deserve, saka po this is something that has reached national significance and it would be very prudent na bigyan na lang natin sila ng pagkakataon na talagang i-verify at siguro i-analyze and evaluate the complaint,” Clavano said.

Clavano said Vice President Duterte may be invited to the DOJ to air her side if prosecutors decide to conduct a preliminary investigation.

“Kasi karapatan po niya 'yan na magsubmit ng counter-affidavit ng kanyang mga depensa, so we are hoping na gamitin din niya or she will take the chance, the opportunity to clear her name na din,” Clavano said.

(Because it is her right to submit a counter-affidavit of  her defenses. so we are hoping she will take the opportunity to clear her name)
