MANILA — The Commission on Elections (Comelec) promised the public on Tuesday that they would release a resolution on Duterte Youth's case soon, as the en banc has yet to formally decide on the group’s issues days before the 20th Congress opens.

Comelec chairman George Garcia said the poll body’s commissioners are carefully assessing the issues lodged against Duterte Youth, whose registration was cancelled early last month, stripping it of the rights and privilege of a party-list.

“Yung division ng Commission, maaaring magkaroon ng ibang pagtingin doon sa kaso lalo na’t may motion for reconsideration at may mga bagong naipresenta na ebidensya o argumento,” said Garcia in an interview.

“Naniniwala tayo na maaaring tatagal pa muli nang kaunti pero ako ay nakikiusap sa ating mga kababayan, kaunting paghihintay na lang ang hinihintay natin dito,” he said.

Garcia said there is “no prohibition or violation” under the law even as they have yet to release the ruling.

"Take note na paglagpas ng June 30, kung walang naiproklama ang Comelec, walang papasok na prohibition o violation sapagkat ibig sabihin, wala pang member ng House of Representatives,” he added.

The Comelec 2nd division's decision released on June 18 stemmed from a 2019 case filed by youth leaders claiming Duterte Youth failed to comply with the jurisdictional requirements of publication and hearing, intention to represent the sector, and issues with alleged funding from the National Youth Commission.

Days later, the Duterte Youth filed a motion for reconsideration seeking to reverse and set aside its ruling.

The group cited insufficient evidence to justify the said ruling of the poll body’s division, which it claims is contrary to law.

On June 24, Garcia said given all these, the case would be elevated to the Commission en banc and will be submitted for resolution.

Duterte Youth won 3 congressional seats after garnering over 2 million votes in the May polls, but Comelec had also suspended its proclamation due to pending cases.
